ARISE CRM LLC Terms and Conditions

1. Agreement to Terms

By accessing or using arisecrm.co or any services provided by ARISE CRM LLC ("we," "us," or "our"), you agree to be bound by these Terms and Conditions and our Privacy Policy, which is incorporated herein by reference. If you do not agree, do not use our website or services.


2. Eligibility and Age Restriction

Our services are intended for business owners and professionals only. You must be at least 18 years old and capable of entering into a legally binding agreement to use our services. By using our services, you represent and warrant that you meet these requirements. We do not knowingly provide services to individuals under the age of 18. If we discover that a user is under 18 we reserve the right to immediately terminate their access.


3. Services

ARISE CRM LLC provides done-for-you review management and marketing services for home service businesses. This includes but is not limited to automated review request campaigns, Google reputation management, and related marketing tools powered through our platform at arisecrm.co. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.


4. SMS / Text Message Program

ARISE CRM LLC operates an SMS messaging program as part of our service delivery. By providing your phone number and agreeing to these terms you consent to receive text messages from ARISE CRM LLC.

Messaging Use Cases

We may send SMS messages for the following purposes:

- Account setup and onboarding instructions

- Service updates and delivery notifications

- Review campaign results and reporting

- Billing reminders and payment confirmations

- Promotional offers and service announcements

- Support and follow-up communications

How to Opt In

You opt in to receive SMS messages by:

- Submitting your phone number through our website contact or sign-up forms

- Booking a demo call or free trial through arisecrm.co

- Verbally agreeing to receive texts during an onboarding call

How to Opt Out

You can opt out of SMS communications at any time by replying STOP to any message you receive from us. After opting out you will receive one final confirmation message and no further texts will be sent. Opting out of SMS communications does not cancel your service subscription.

Message Frequency

Message frequency varies based on your account activity and service plan. You may receive up to 4-8 messages per month related to your account, results updates, and service communications.

Message and Data Rates

Standard message and data rates may apply depending on your mobile carrier and plan. ARISE CRM LLC is not responsible for any charges incurred from your carrier related to SMS communications.

Carrier Liability Disclaimer

Carriers such as AT&T, Verizon, T-Mobile, and others are not liable for delayed or undelivered messages. Message delivery is not guaranteed and may vary based on carrier, device, and network conditions. ARISE CRM LLC is not responsible for any failures in SMS delivery caused by your carrier or network.

No Sharing of SMS Opt-In Information

Your SMS opt-in information will never be shared, sold, or transferred to third parties for marketing purposes. This information is used solely to communicate with you about your ARISE CRM LLC account and services.


5. Account Responsibilities

You are responsible for:

- Providing accurate and complete information when signing up

- Maintaining the confidentiality of your account credentials

- All activity that occurs under your account

- Notifying us immediately of any unauthorized use of your account


6. Payment Terms

- All fees are due as specified at the time of purchase

- Subscription fees are billed on a recurring basis until cancelled

- All payments are processed securely through our third-party payment processor

- All sales are final unless otherwise stated in our refund policy

- We reserve the right to change pricing with reasonable advance notice

- Failure to pay may result in suspension or termination of your account


7. Refund Policy

Due to the nature of our services all payments are generally non-refundable. If you believe you are entitled to a refund contact us at [email protected] within 7 days of your purchase and we will review your request on a case-by-case basis.


8. Cancellation

You may cancel your subscription at any time by contacting us at [email protected]. Cancellations take effect at the end of the current billing period. You will not receive a refund for the remaining period after cancellation.


9. Client Responsibilities

You agree to:

- Provide accurate business information and customer data necessary for service delivery

- Ensure you have proper consent from your customers before submitting their contact information to us for review requests

- Comply with all applicable laws including CAN-SPAM, TCPA, and any other regulations governing customer communications

- Not use our services for any unlawful or fraudulent purpose


10. Intellectual Property

All content, materials, and technology provided by ARISE CRM LLC — including but not limited to workflows, templates, copy, and systems — remain the intellectual property of ARISE CRM LLC. You may not copy, reproduce, or distribute our materials without written permission.


11. Confidentiality

Any proprietary systems, processes, or strategies shared with you as part of our services are confidential. You agree not to share, replicate, or disclose these to third parties.


12. Disclaimer of Warranties

Our services are provided on an "as is" basis. We make no guarantees regarding specific results including the number of reviews generated, improvements in search rankings, or increases in revenue. Results may vary based on factors outside our control including client cooperation, market conditions, and platform algorithm changes.


13. Limitation of Liability

To the fullest extent permitted by law ARISE CRM LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability to you for any claim shall not exceed the amount you paid us in the 30 days prior to the claim.


14. Indemnification

You agree to indemnify and hold harmless ARISE CRM LLC, its owners, employees, and affiliates from any claims, damages, or expenses — including legal fees — arising from your use of our services, your violation of these terms, or your violation of any third-party rights.


15. Third-Party Platforms

Our services interact with third-party platforms including Google, GoHighLevel, and others. We are not responsible for changes to third-party platforms that may affect service delivery. You agree to comply with the terms of service of any third-party platforms used in connection with our services.


16. Termination

We reserve the right to suspend or terminate your access to our services at any time for violation of these terms, non-payment, or any other reason at our discretion. Upon termination your right to use our services ceases immediately.


17. Governing Law

These Terms and Conditions are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Florida.


18. Dispute Resolution

Before initiating any legal action you agree to contact us at [email protected] to attempt to resolve the dispute informally. We will make reasonable efforts to resolve any issues within 30 days.


19. Privacy Policy

Your use of our services is also governed by our Privacy Policy, which can be found at arisecrm.co/privacy-policy. By using our services you acknowledge that you have read and agree to our Privacy Policy.
